This Special Meeting was called to order at 7:30 pm. The agenda for tonight will be the reading of the minutes of the April 16th, and May 21st, 2002 meetings, three public hearings concerning applications 01-02, 04-02, and 05-02, and anything else the Board wishes to discuss.
The minutes of the April 16th, 2002 meeting were unavailable due the sudden illness of a Board member.
The announcement of the public hearing on application 01-02 as published in the Daily Gazette was read. The public hearing on application 01-02 was opened to the floor for comment. There was none. Floor closed. Omer Martratt made a motion to approve that portion of the public hearing. Michael Brosnan seconded. Member Martratt, aye; Chairperson Brosnan, aye; Member Wall, aye; Member Uveges, aye; Member Payst, aye. Omer Martratt and Don Uveges made a site plan review of the property. The Board discussed the proposed usage of the property to ensure its compliance with the Ordinance definition of Home Occupation. Don Uveges made a motion to accept the application. The Board reviewed application of Leslie and Denise Taylor of 324 Cole Road for an area variance to allow the subdivision of land with less than a sixty (60) foot front road frontage. The notice as published in the Daily Gazette was read. The Board has property tax bills showing the property as being two separate parcels, not one as shown on the application. The floor was opened for comment. Fred Siegel commented on the Planning Board agenda. As noted at the previous meeting, several neighbors voiced support for this application. Floor closed. Michael Brosnan made a motion to close the public hearing. Omer Martratt seconded.

Michael Brosnan made a motion to grant an area variance to Leslie and Denise Taylor, to allow the subdivision at 324 Cole Road with fifty one (51) feet of road frontage instead of the required sixty (60) feet, providing all other aspects of the Ordinance be followed. Don Uveges seconded. Chairperson Brosnan, aye; Member Uveges, aye; Member Martratt, abstain; Member Wall, aye; Member Payst, aye.
The notice for a public hearing for Steven and Lauri Trianni requesting a twenty (20) foot side yard variance as published in the Daily Gazette was read. The Board asked questions concerning the leach field, use of the proposed pole barn and use of the rest of the property. The Board discussed with Mr. Trianni as to why some other portion of the property could not be used. The building will be used to garage a car and a tractor and for storage. The floor was opened for comment. Fred Siegel of Mariaville Lake, a nearby neighbor, voiced approval for the location of the structure as there not being any other practical site. Michael Brosnan made a motion to close the public hearing. Pat Wall seconded. Chairperson Brosnan, aye; Member Wall, aye; Member Martratt, aye; Member Uveges, aye; Member Payst, aye. The Board had more questions concerning the slope of the land around the house and drainage. More discussion was held concerning the proposed pole barn’s roof lines and the slope of the land. The Board completed the review of the application. This is a type II action and all the requirements of the SEQRA are met. Pat Payst made a motion to grant to Steven and Lauri Trianni of 759 Millers Corner Road, tax map #33.00-1-7, a twenty five (25) foot south side yard variance to erect a twenty four (24) by forty (40) foot pole barn, which does not change the character of the neighborhood, due to the practical difficulties of a septic system in the north side yard, a well and shed in the rear yard, providing a building permit be obtained within six (6) months and all other aspects of the Ordinance be followed. The minutes of the May 21st, 2002 meeting were read. Michael Brosnan made a motion to accept the minutes with the one addition noted. Don Uveges seconded. Chairperson Brosnan, aye; Member Uveges, aye; Member Martratt, aye; Member Wall, aye; Member Payst, aye.
The Board received a letter from County Planning inviting interested Board members to a workshop on storm water management and erosion control to be held on June 25th the Schenectady County Community College.
The Board received from the Town Board a copy of a proposed local law concerning Zoning Board members and would welcome their reviews and comments.
