Zoning Board of Appeals Special Meeting November 30, 2004

This special meeting was called to order at 7:30 pm. The agenda for tonight will be as follows: a public hearing on application 04-015 submitted by Gary Courtright seeking a variance to construct a pole barn and reading of the minutes from the previous meeting.

The minutes of the November 16th, 2004 regular meeting were read. Carl Wiedemann made a motion to accept the minutes with the one correction noted. Don Uveges seconded. The notice of Public Hearing as published in the Daily Gazette on November 20th, 2004, was read. The floor was opened for comment. There was none. The floor was closed.

The Board reviewed the application submitted by Gary Courtright of 282 Batter Street, Pattersonville, seeking a 20 foot side yard and a forty foot rear yard variance to construct a 30 foot by 40 foot pole barn. The Board was reminded of the right of way restraint on this property. This is a Type II action and all the requirements of the SEQRA have been satisfied. The Board completed the findings and decision sheet which is based on Section 14.5.2(B). Carl Wiedemann made a motion to grant to Gary Courtright of 282 Batter Street, Pattersonville, SBL# 35.05-1-26, a preexisting undersized lot, a forty (40) foot rear yard setback variance and a twenty (20) foot front yard setback variance to construct a thirty (30) foot by forty (40) foot single story pole barn per the findings of Section 14.5.2(B), providing a building permit be obtained within six (6) months and all other aspects of the Ordinance be followed.
