This regular meeting was called to order at 7:30 pm. The agenda for tonight will be as follows: two public hearings, the reading of the minutes from the previous meeting, possible action on these hearing applications, review of 3 new applications, and anything else the Board wishes to discuss.
The public hearing notice for the application submitted by Jennifer DeCaprio of 453 Batter Street, Mariaville, was read. This notice on application 04-007 was published in the Daily Gazette on June 3rd, 2004. The floor was opened for comment. There was none. The floor was closed.
The notice of public hearing as published in the Daily Gazette on June 3rd, 2004, concerning Eric Bratt of 1680 Mudge Road, Delanson (application 04-005), was read. The floor was opened for comment. There was none. The floor was closed.
The regular business meeting started. The minutes of the ZBA special meeting held on June 1st, 2004, were read. Carl Wiedemann made a motion to accept the minutes as read. Evie Rudesheim seconded. Application 04-007 submitted by Jennifer L. DeCaprio was discussed. The Board documented the requirements of Section 14.5.2(B) as relating to this application. This is a Type II action and all the requirements of the SEQRA have been satisfied. Should the proposed sewer system be constructed and utilized by the owners of this dwelling, this property would then meet the minimum side yard setback distance per Section 7.6. Carl Wiedemann made a motion to grant to Jennifer L. DeCaprio of 453 Batter Street, Mariaville, SBL#35.09-1-11.21, a fifteen (15) foot south side yard setback variance and a twenty five (25) foot front line setback variance to construct a twenty eight (28) foot by twenty two (22) foot single story attached garage providing a building permit be obtained within six (6) months and all other aspects of the Ordinance be followed. Application 04-008 submitted by Eric Bratt of 1680 Mudge Road was reviewed for completeness and discussed by the Board. All the Board members present have done drive bys. Mr. Bratt presented the Board with a copy of the deed. There is a right of way for drainage in the east side yard. The Board documented the requirements of Section 14.5.2(B) as relating to this application. This is a Type II action and all the requirements of the SEQRA have been satisfied.
Evie Rudesheim made a motion to grant to Eric Bratt of 1680 Mudge Road, Delanson, SBL# 44.00-2-32, a twenty five (25) foot front yard set back variance for the purpose of constructing a twenty four (24) foot by forty (40) foot one story garage providing a building permit be obtained within six (6) months and all other aspects of the Ordinance be followed. The Board reviewed Application 04-009 submitted by Robert C. Kneise of 772 Van Patten Road who is requesting a side yard setback variance to construct a garage on an undersized lot. The application is incomplete and the Board requests that the applicant supply a location map, location of all present and proposed structures, adjoining property owners, adjoining wells and septic systems within 100 feet of the property lines and a deed for this property. Don Uveges made a motion to schedule a public hearing on this application for Tuesday July 20th, 2004 at 7:30 p.m. in the Town Hall. Carl Wiedemann seconded. Application 04-010 submitted by Leonard J. Bala of 11865 Duanesburg Road, Delanson, was reviewed for completeness by the Board. Mr. Bala is requesting a sideline setback variance to construct a single story garage with an attached carport. This application is incomplete. The Board asked Mr. Bala to submit a location map, the location of the house on the property as well as identifying adjoining property owners and their well and septic system locations if within 100 feet of the property line. The Board reviewed application 04-011 submitted by Eugene Hotaling of 1311 Eaton Corners Road, Delanson. Mr. Hotaling is requesting a side yard setback variance to construct a single story garage. This application is incomplete. Mr. Hotaling was asked to supply a location map and a copy of the deed. Chairperson Wall read a letter from Chapter 88 of the Disabled American Veterans stating they had a van available for medical related trips to the VA Hospital in Albany. This vehicle will be available on a first come, first serve basis with a one (1) week advance reservation requirement. Pickup is at the K-Mart in Scotia and at the Dunkin Donut at the I-88/Thruway entrance in Rotterdam.
There was a zoning district change from C1 to C2 just west of the intersection of Western Turnpike and Schoharie Turnpike. The property owner plans to construct self storage units.
There will be Planning and Zoning classes held at various locations this summer. Enrolment forms are available if anyone is interested in attending.
A letter from the Town of Princetown stating that a negative declaration of environmental impact has been issued for the proposed subdivision at Western Turnpike and Settles Hill Road.
