This meeting was called to order at 7:30 pm. The agenda for tonight will be as follows: three public hearings, the regular meeting consisting of the reading of the minutes from the previous meeting, possible action on these hearing applications, review of a new application, and anything else the Board wishes to discuss.

The public hearing notice for the application submitted by Robert C. Kneise jr. of 772 Van Patten Road, Duanesburg, was read. This notice on application 04-009 was published in the Daily Gazette on June 28th, 2004. The floor was opened for comment. There was none. The floor was closed.

The notice of public hearing as published in the Daily Gazette on June 28th, 2004, concerning Leonard J. Bala of 11865 Duanesburg Road, Delanson (application 04-010), was read. The floor was opened for comment. A letter written by Michael R. Rafferty was read stating he had no objection to the proposed garage and carport and was in favor of the proposed location. The floor was closed.

The notice of public hearing as published in the Daily Gazette on June 28th, 2004, concerning Eugene Hotaling of 1311 Eaton Corners Road, Delanson (application 04-011), was read. The floor was opened for comment. There was none. The floor was closed.

The regular business meeting started. The minutes of the ZBA meeting held on June 15th, 2004, were read. Don Uveges made a motion to accept the minutes as read. Carl Wiedemann seconded. Application 04-009 submitted by Robert C. Kneise jr. was discussed. Drive bys were made by Kathleen Kosinski, Carl Wiedemann, Evie Rudesheim, and Pat Payst. Mr. Kneise present the Board with a location map, location of proposed and existing structures on his lot, a list of adjoining property owners, a deed for this property, and the location of septic systems and wells within 100 feet of the property lines. The Board documented the requirements of Section 14.5.2(B) as relating to this application. This is a Type II action and all the requirements of the SEQRA have been satisfied. Carl Wiedemann made a motion to grant to Robert C. Kneise, jr. of 772 Van Patten Road, SBL#55.00-4-5.1, a fourteen (14) foot west side yard setback variance to construct a twenty four (24) foot by twenty six (26) foot single story detached garage providing a building permit be obtained within six (6) months and all other aspects of the Ordinance be followed. Application 04-010 submitted by Leonard J. Bala of 11865 Duanesburg Road, Delanson, was reviewed by the Board. Don Uveges, Carl Wiedemann, and Pat Payst have done drive bys. Mr. Bala presented the Board with a copy of the deed, a list of adjoining neighbors and locations of their wells and septic systems within 100 feet of the property lines. A significant portion of the rear yard experiences seasonal flooding which limits rear yard usage. The Board documented the requirements of Section 14.5.2(B) as relating to this application. This is a Type II action and all the requirements of the SEQRA have been satisfied. Carl Wiedemann made a motion to grant to Leonard J. Bala of 11865 Duanesburg Road, Delanson, SBL# 44.00-2-32, a twenty (20) foot west side yard set back variance for the purpose of constructing a twelve (12) foot by twenty four (24) foot one story detached garage with an attached twelve (12) foot by twenty four (24) foot carport providing a building permit be obtained within six (6) months and all other aspects of the Ordinance be followed. The Board reviewed application 04-011 submitted by Eugene Hotaling of 1311 Eaton Corners Road, Delanson. Mr. Hotaling is requesting a side yard setback variance to construct a single story garage. This is a Type II action and all the requirements of the SEQRA have been satisfied. Drive bys were done by Evie Rudesheim, Don Uveges, Carl Wiedemann and Omer Martratt. Mr. Hotaling supplied a location map and a copy of the deed. The Board documented the requirements of Section 14.5.2(B) as relating to this application. Carl Wiedemann made a motion to grant to Eugene Hotaling of 1311 Eaton Corners Road, Delanson, SBL#42.00-1-10.11, a ten (10) foot south side setback variance to construct a twenty four (24) foot by twenty eight (28) foot single story detached garage providing a building permit be obtained within six (6) months and all other aspects of the Ordinance be followed. The Board reviewed Application 04-012 submitted by Gary Courtright of 282 Batter Street, Mariaville who is seeking a side yard setback and a rear yard setback to construct a thirty (30) foot by fifty (50) foot pole barn on a preexisting undersized lot. Mr. Courtright was asked to bring to the next meeting the deed dated prior to May 31st, 1984, a location map, adjoining property owners and their well and septic system locations within 100 feet of the property lines. Once the Board receives all this information it can than schedule a public hearing.

The Board discussed the lack of information presented by applicants seeking variances and possible ways to have that information available when the applicant first meets with the Board. It was suggested that copy of the Ordinance be supplied to the applicant along with the application. The Board is also considering a somewhat standardized graphical representation of the site plan requirements detailed in the application.
