This regular meeting was called to order at 7:30 pm. The agenda for tonight will be the reading of the minutes from the previous meeting, a public hearing and possible action on application 04-001 submitted by Arthur Crandall seeking a Home Occupation Business Permit, review of a new application, and anything else the Board wishes to discuss.

The minutes of the ZBA regular meeting for January 20th, 2004 were read. Wendy Graves made a motion to accept the minutes with the one correction noted. Don Uveges seconded. Member Graves, aye; Member Uveges, aye; Chairperson Wall, aye; Member Martratt, aye; Member Payst, aye.

Pat Wall read the notice of Public Hearing as published in the Daily Gazette in reference to Arthur Crandall of 731 Cole Road, Delanson who is seeking a Home Occupation Business Permit to operate a Barber Shop. Mr. Crandall presented the Board with amended plans showing the proposed parking area with a crushed stone surface. Wendy Graves did a drive by. The floor was opened for comment. Norma Norton of 690 Cole Road spoke in favor of this home occupation. The floor was closed. Omer Martratt and Don Uveges visited the property for the purpose of performing a site plan review. They reported in favor of this home occupation. The Board reviewed the application and Sections 14.5.4 and 3.5.64 of the Ordinance. The Board discussed traffic and other impacts on the neighborhood and determined there would be minimal impacts. Wendy Graves made a motion to authorize the Uniform Code Enforcement Officer to issue a Home Occupation Business Permit to Arthur Crandall of 731 Cole Road, Delanson, SBL#66.00-6-10.16 for the purpose of operating a one chair barber shop providing a permit be obtained with six months and all other aspects of the ordinance be followed. The Board reviewed application 04-002 submitted by Jennifer DiCaprio of 453 Batter Street, Pattersonville requesting side yard and front yard setbacks for the purpose of constructing a three stall garage. The Board asked the applicant to bring to the next meeting the following: a legible deed for this property and the property across the street as this is the location of the septic system, tax maps and plot plans for both properties. This information is necessary before the Board can schedule a date for a public hearing.

Omer Martratt read from his notes covering many subjects such as: applicants appearing before the Board without all the required information, public hearings not starting on time, scheduling of old and new business, asking the applicant if the information is true and correct to the best of his knowledge, asking if any construction has been done. Also the applicant should obtain a copy of the Ordinance, it is also his responsibility to furnish all the required information, a current legible deed that extends prior to the May 1984 date requirement, a survey map of the property, property line markers so the UCEO has measurement references, and a plot plan to scale with measurements showing existing and proposed structures, water lines, sewer lines/septic systems. Also, the voting on motions should be by roll call with the motion maker voting first. The Board had short discussions on these items. Member Martratt was asked to make copies for all the Board members so they can further discuss these items.
