Public Hearing October 24, 2005 Revising, the Sewer Permit Charge Schedule for the Town of Duanesburg Mariaville Lake Sewer District NO. 2 Sanitary Sewer Collection System.

Present was Councilmembers Carlson, Frisbee, Pneuman, Potter and Supervisor Merrihew.

Public Hearing opened at 6:35PM and read the legal notice as published in the Gazette Newspapers on October 17, 2005.

Floor opened to comments. No one wished to speak floor closed.

Council-member Frisbee offered the following motion, seconded by Council-member Carlson:

RESOLUTION #152-05 A RESOLUTION REVISING THE SEWER PERMIT CHARGE SCHEDULE FOR THE TOWN OF DUANESBURG MARIAVILLE LAKE SEWER DISTRICT NO. 2 SANITARY SEWER COLLECTION SYSTEM.

WHEREAS, the Town Board of the Town of Duanesburg adopted the Town's Sewer Use Law for Mariaville Lake Sewer District No. 2 with amendments including the Proposed Schedule of Sewer Permit Charges on July July 14,_____, 2005; and

WHEREAS, the project construction period was initially planned to be completed in June 2005 and was extended into September 2005 due to various construction related issues; and

WHEREAS, the Town issued a letter to residents in the sewer district on September 19, 2005 stating that they may connect to the system; and

WHEREAS, the treatment plant and collection system did not incur any operational costs until October 2005; and

WHEREAS, McDonald Engineering prepared a revised Schedule of Sewer Permit Charges that provides for no prorated operation and maintenance charge and no administrative surcharge in the year 2005 to encourage property owners to make their connection to the system in 2005; now, therefore

BE IT RESOLVED that Town Board adopts the attached revised Schedule of Sewer Permit Charges.
