Regular Town Board Meeting June 13, 2002

Members Present Council-members Hyland, Merrihew, Pneuman, Potter. Supervisor LaBelle. Also present was the Attorneys for the Town, Fassett, and Siegel.

Invocation and Pledge to the flag led by Supervisor LaBelle.

Supervisor LaBelle asked for any comments on the agenda.

No one wished to comment. Regular Meeting called to order.

Resolution #94-02 – Council-member Merrihew motioned, seconded by Council-member Pneuman to accept the town meeting minutes of May 9, 2002 as presented. Motion carried 5 Ayes.

Supervisor LaBelle read the Clerk’s and the Supervisor’s report for the month of May. (Attached)

Resolution #95-02 – Council-member Merrihew motioned, seconded by Council-member Potter to pay all of the claims. From the General Fund $13,935.24 Highway Fund total $6,101.45, Park Fund $520.00, Street Lighting District $918.14, Total vouchers for the month, $21,474.83. Motion carried 5 Ayes.

Council-member Pneuman reported on the highway. Highway Superintendent has completed the preliminary specs for the new truck at the highway department. The committee and some residents will review and give their input. That should be ready by the next meeting.

Council-member Merrihew reported on the parks. The summer swim program is July 8th through July 19th at the Y in Guilderland. Park Program is for three weeks beginning July 21st. There should be flyers coming home with the kids from school.

The Park Committee has been working with Dave Mosher from Schenectady County Soil and Water to obtain trees and shrubs for the parks. We can get about 120 trees, which are about 6’-8’ tall. There is no cost to us other than going to Glenville to pick them up. We would plant them ourselves.

Mr. Jeff West and Mr. Jayme Lahut are here this evening to give their annual report on Schenectady Metroplex. Copies are available in the Town Hall. Metroplex’s financial condition still continues to be in excellent shape. Eight million dollars have been bonded earlier this year. Over the course of the past two years more than thirty million dollars have been committed to projects around Schenectady County.

 

Supervisor LaBelle thanked Mr. West and Mr. Lahut for coming this evening.

Resolution #96-02 – Supervisor LaBelle motioned, seconded by Council-member Potter to adopt a Local Law for the appointment of alternates to the Planning Board and the Zoning Board of Appeals. Motion carried 5 Ayes.

Council-member Merrihew asked if the Supervisor contacted the Chairman of each board.

Supervisor LaBelle there was no response from the Zoning Chairman, the Planning Chairman was for it.

Resolution #97-02 – Council-member Merrihew motioned, seconded by Council-member Pneuman to authorize the Supervisor to enter into a contract with a grant writer to obtain preliminary information concerning grants available for the Town of Duanesburg and the cost of services provided. Said contract not exceed $1,000.00. Motion carried 5 Ayes.

Resolution #98-02 – Supervisor LaBelle motioned, seconded by Council-member Potter for the Town Board to adjourn to executive session at 7:45 pm, for the purpose of discussion the sewer district and school district. Motion carried 5 Ayes.

Town meeting resumed at 8:19pm.

Resolution authorizing the Supervisor to enter into a contract for repairs to Camile Rafferty’s property.

Supervisor LaBelle stated that before the town spends money, we should try and solve the problem.

Supervisor LaBelle explained the problem. She has had water coming onto her property since the sewer line was installed. No one seems to know where the water is coming from.

Council-member Hyland it seems fairly clear the problem is not easily identifiable. Thinks it would be feasible to look and see if they believe connecting her lateral to the storm sewer would solve her problem. If that seems to be a reasonable thing to do, then possibly we might consider an agreement to help fund that project.

Council-member Merrihew stated that the Code Enforcement Officer spoke with the County Engineer and there is a possibility that he would go out and look at.

Supervisor LaBelle suggested that maybe the Highway Superintendent and the County Engineer take a look at. The board tabled this until next month.

Resolution #99-02 – Council-member Merrihew motioned, seconded by Council-member Hyland for the Town Board of the Town of Duanesburg hold a public hearing on Thursday September 12, 2002 at 7:00pm, 5853 Western Turnpike for the purpose of receiving comments from the public on the Town’s proposed Agency Plan for 2002 for Section 8 Rental Assistance Program. Copies of the Agency Plan and all supporting documentation are available for review by the public at either of the following locations:

Town of Duanesburg and Joseph E. Mastrianni, Inc. Motion carried 5 Ayes.

Council-member Pneuman explained that Joseph Mastrianni administers the

Federal Section 8 Housing Assistance for us. Federal Law says we have to hold a public hearing on this and notification is 45 days ahead of time.

Resolution #100-02 – Supervisor LaBelle motioned, seconded by Council-member Potter the following budget transfers: Motion carried 5 Ayes.

From: 9010.8 $3,000.00 Undistributed State Retirement Fund Account

To: 8010.2 1,500.00 Zoning Equipment Fund and

To: 1355.2 1,500.00 Assessor’s Equipment Fund

Increase by $10,000.00 Insurance Recoveries account 2680.1

Increase by $10,000.00 Attorney’s Contractual Account 1420.4

Transfer $10,000.00 from 1990.4 Contingency account to 1420.4 Attorneys contractual account.

Council-member Merrihew commented that the $1500.00 transferred to the Zoning and Assessor equipment accounts is for the purchase of two new computers for those departments. Supervisor LaBelle read letter from Fred Dykeman regarding the annual Fourth of July celebration, asking the town for its help as one of the sponsors.

Resolution #101-02 – Council-member Potter motioned, seconded by Council-member Merrihew for the town to make a $1,000.00 donation to the Duanesburg Business Association for the annual Independence Day Celebration. Motion carried 3 ayes Potter, Merrihew, LaBelle. One no Pneuman, one abstain Hyland.

Clerk read the notice as published in the Daily Gazette on May 23, 2002 for the sale of used surplus highway equipment.

Supervisor LaBelle read the five bids that were received.

  1. Turnpike Glass, Walter Hyson $50.00 on item #7 riding mower.
  2. Esperance Gas, Donald Largeteau $55.00 on item #12 wheel covers, item #6 $500.00 steel sanding unit.
  3. Schoharie County Spring Works – consider a trade on item #17 even for a 1997 Johnson 4 wheel gutter double broom street sweeper with approximate value of $25,000.00. Machine has 3000 hours, new center broom and tires, 6 cyl turbo diesel engine. Machine is in excellent condition.
  4. James A. Gaylord Barton Hill Road Delanson bid on item #10 pony motor $310.00.
  5. R. Halgas Construction & Equipment Co. bid on item #6 stainless steel sanding unit $957.02, and item #13, 7 short handle coal shovels bid $21.02.

Resolution #102-02 – Council-member Merrihew motioned, seconded by Council-member Potter to pay the utility bills and postage for postage meter before the regular abstract. Motion carried 5 Ayes.

Council-member Merrihew stated that this has been done all along, but a resolution could not be found on the books to do that.

 

Supervisor LaBelle explained a letter from sent to the Town from the Engineer stating the town needs a resolution to costs associated with sewer hookup along the D&H RR. The costs were pertaining to consulting fees to have a D&H Engineer on site during the installation of pipes and building the road to the treatment plant. The Engineer has negotiated the costs down to $64,850.00. Payment would be made from grant money available and will not effect the overall cost of the system.

Resolution #103-02- Council-member Merrihew motioned, seconded by Council-member Hyland to expend $64,850.00 for the payment of consulting fees to the D&H Railroad. Motioned carried 5 Ayes.

Supervisor LaBelle stated that the Code Enforcement Officer has taken a core and category 8 training program for the Conservation Department. It was an 8hour course last year and 30 hours this year. He has one more year to go and then he will be certified for pesticides throughout the town. He has spent a lot of work on this and should be commended.

No other business, privilege of the floor opened at 8:50pm.

Frank Way – Mariaville Lake – asked for an update on the zoning issues on the lake.

Attorney Fassett responded that litigation is pending.

George Lent – Route 7 - Last month Council-member Merrihew spoke about Mr. Lawrence drilling a well at the park and charging the town only half of the cost for labor. He asked if the town has considered sending him a thank you note?

Council-member Merrihew stated that yes a card was sent and she tries to always out notes for that type of thing.

Mr. Lent asked how much the platform in the boardroom cost?

Supervisor LaBelle stated under $1,000.00 thanks to Council-member Potter.

Pat Wall – McGuire School Road – She is representing the Senior Nutrition Program. Seniors can get a hot meal every Mon-Wed- Fri at the Bishop Scully Hall at Our Lady of Fatima in Delanson. There is transportation to the site and also to shopping. There is delivery of the meals to shut ins. She is asking everyone help in letting people know about the program. There are opening for people who are shut ins and they feel that they are not reaching them in town, we are not getting the word out. It is administered through the county and some of the funding is through county and state grants and Catholic Family Charities.

Supervisor LaBelle stated that Mrs. Wall delivers meals to the shut ins and a few years ago she found one of his neighbors that had had a stroke and was not able to use a phone to get help.
