Meeting called to order at 7:33pm.

Public Hearings
Richard E. Brush, Jr. and Gloria Farone are seeking approval for a two lot minor subdivision, SBL#43.00-1-3.12 on Miller Corners Road. Lot #1 is 3.37 acres and Lot #2 is 3.37 acres. There were several neighbors in the audience with concerns regarding the drainage of the land and the construction of two homes on this parcel changing the character of the neighborhood. Hearing closed.
Leonard and Ann Taylor of 974 Mariaville Scotch Church Road are requesting approval for a minor subdivision of 67+- acres into two lots. Lot A is 35.62 acres and Lot B is 32.31 acres. There were no comments from the audience on this project. Board clarified necessary additions had been made to the application. Hearing closed.
Charles and Sally Ann Wilber are requesting approval for a three lot major subdivision on Main Street. SBL#66.00-1-10.1. Lot #1 is 42.04 acres, Lot #2 is 2.71 acres, Lot #3 is 106 acres. Audience raised no concerns but some neighbors wished to clarify the location and size of the lots. Hearing closed.

Clyde and Kathleen Kendle, Owners/ David H. Lee, Applicant are applying for a minor subdivision of 5.29 acres, SBL#33.00-2-11.11 to be conveyed to David H. Lee upon approval. The initial parcel is 11 acres. Some concern over need for a deed adjustment to stipulate a lot line adjustment to avoid a land locked parcel. Motion made by Laura Silva seconded by Fred Siegel, to set a Public Hearing on November 4, 2004 in the application of Clyde and Kathleen Kendle for a minor subdivision of 5.29 acres. Francis H. Potter, Owner/ Town of Duanesburg represented by Edward Fassett Applicant applying for a one lot minor subdivision of 4.0+- acres on Mariaville Road, SBL#34.00-1-15.1 for the purpose of constructing Municipal Sewage Plant for Sewer District #2. Board asked for a complete map of the area including contour lines, Ag disclosure and a copy of the driveway ingress/egress, as well as the entire parcel being subdivided with existing houses wells and septic. The Board asked that the engineer be present for questions, as this would be helpful to the Board and the discussion will be on the public record.

Application #1 SBL#68.00-3-24 and SBL# 68.00-3-27.51, to adjust the boundary line between two parcels, subdividing one of the lots into two lots. Lot #1 is 9.11+- acres, Lot #2 is 6.51 acres and Lot #3 is 6.07 acres.
Application #2 SBL#68.00-3-27.3 and SBL#68.00-3-25.2 on Darrow Road, subdividing two existing parcels into 3 lots. Lot #1 is 20.5 acres, Lot #2 is 10.86 acres and Lot #3 is 34.89+- acres. Clarified need for completed application with septic disclosure to be submitted.
Motion made by Laura Silva seconded by Fred Siegel to set a Public Hearing on November 4, 2004 for Applications #1 and #2 of the Estate of Roger and Lillian Wagner/Executrix Nancy Laraway, for the subdivision of four parcels into six parcels.

Douglas Yauchler, II owning property at 6921 Duanesburg Road, SBL#67.05-2-11 is applying for a Special Use Permit for the purpose of having storage on lower level with retail space on the first floor. Clarified the ordinances for retail spaces, including parking and hamlet location of the parcel. Proposed building would be 1800 square foot retail space. Motion made by Fred Siegel seconded by Mark DeLeva to set public hearing for November 4, 2004 on the Douglas Yauchler application for a Special Use Permit for building storage and retail space. Clarified changes made to the Environmental Form. No issues with Fish and Wildlifeand NYSDEC. There was no input from County Planning at this meeting so parties decided to wait to hear from the county before moving on.
