Planning Board Minutes August 18, 2005 Final Copy
Members present: Laura Silva, Chair, Martin White, Mark Deleva, Walt Miller, Sandra Scott, Fred Siegel, Gino Santabarbara, Town Planner, Maryann Murphy, Secretary
As the meeting first came to pass Don and Donna Cooper asked that the board review their application for a public hearing which got lost in the UPS mail.
Public Hearings:
Anna Kostadinova has submitted an application for a minor subdivision at 10 Courtney Drive; the application is to divide the 5-acre lot into two smaller lots. Anna did not show up for the July meeting as well as the August meeting, therefore the board decided that the application is considered withdrawn due to failure to appear. Laura will be sending a letter of notification stating the withdrawal.
Paul J. Winnie SBL# 76.00-2-6.1 is seeking approval for a special use permit to construct a storage barn at his vacant property on Crow Hill road, Schenectady County approves of the proposal. No current questions at this time from the audience.
Kevin Chesnut SBL# 54.00-1-10.1 is seeking approval for a 6 lot major subdivision, in phase two, known as Chestnut Hills
on Delevan Road. Lots will range in size from 4.0 acres to 9.16 acres.
Lance Manus spoke on Kevin's behalf.
They applied for a DEC stream-crossing culvert. The subdivision was reduced from a 6-acre lot to a five-acre lot. They
cannot build until they get DEC approval that the Wastewater will have a place to disperse. No one present to make comments, Ward Humphrey asked to see the plans.
No Comments.
Martin White wants to know about the right of way for the road into the subdivision and who will be deeded easement
rights.
Gino Santabarbara " It is a tight 4.9 acres and you cannot disturb anymore, and you must stay inside all boundaries, and
must stay under 5 acres, to make sure it meets SWPPP. They must make a new SWPPP and outline, because the
layout of the subdivision has changed."
Lance: " More space was given by eliminating one house from the subdivision."
Gino: "We need detail in the map and in the deeds to know limits of grading and disturbance, for say a pool, or pasture for
their horse (should they desire one) etc. "
Fred: " It's absurd to know the quality control and the people should be entitled to live in their own style."
Laura: "OK, next hearing."
Tom Spoor:
Planning a 9 lot subdivision consisting of its own road a 1000 foot cul-de-sac, 4 lots at approximately 2.6 acres, and 5
lots 5 acres or greater. Has had "test" well done and got 8-10 gallons per minute, at 180 feet deep with 160 feet of casing,
the road detail is included.
No questions or comments from the audience.
Chuck Johnson: " It doesn't make any logical sense about the SWPPP and water quality and quantity disturbing septic
lawns, because there is only limited paved surface and runoff, and no wet lands.
Gino: "Where is the runoff from erosion grading going?"
Tom: "Each house is in a different location making the SWPPP hard to predict."
Gino: "Talk to DEC and see what they say about disturbing 5 acres of land."
Chuck J.: "All of it seems absurd and like it doesn't need to be done. I feel it doesn't make any sense to include grading
as disturbance for SWPPP since it is temporary." "
Gino: "Well you need to get a letter from NYS DEC telling us that it is not included as disturbance for a SWPPP."
Chuck J. " I have done research and it is not included, so I will get a letter from NYS DEC.":
Tom: "I want to change the plans for the cul-de-sac making it all pavement instead of greenery."
Gino: "If greenery it would have to be deeded to one homeowner so it doesn't get left without being mowed, and tended
too."
Steven and Keith Longtin:
SBL#: 66.00-2-2.1, is planning a 2 lot minor subdivision, for the property on Main Street in Delanson. They will create two
lots, lot 1 being 42.2 acres and lot 2 being 21.3 acres with a common driveway.
No questions or comments from the audience.
Schenectady County approves of project.
Gino: "Put a curb cut into plans, state road and permit."
Steve: "With an already existing driveway to access the property they cannot deny a driveway permit.
"Jeff Iveson who is in charge of the village water came out, and said, "There wasn't a problem they were concerned with."
Gino: " What about DOT approval for driveway permit?"
Steve: "The driveway already exists therefor they cannot say there is a problem.
The board heard the request brought up the beginning of the meeting for Don and Donna Cooper and agreed to a public hearing for September 18th 2005.

New Business:
Alan Krieger: is dividing 5.7 acres into two parcels, With no plans to build.
Walt: "Why separate the land if there is enough space to put his own driveway in?
Gino: "We will need a maintenance agreement for the shared driveway."

Old Business:
Helene Thomas: Owning property at 364 Wells Road, SBL#: 25.00-1-7.1 is seeking approval for a two lot minor
subdivision that was reviewed at the July meeting. The proposed subdivision would create one 2.3-acre lot and one
18.81-acre lot from the original parcel of 21.11 acres. An issue with the ditch needed to be addressed at the August
meeting.
Gary Boardo:" There is no water currently affecting any area of the property."
Second issue with the property to the north and the claim that the culvert under the road dumping wastewater onto their
property. In a dye test on the house conducted by the County it came up as no evidence of wastewater.
County has approved, of the subdivision.
The June minutes were reviewed and approved. Laura Silva motioned the approval & Mark Deleva seconded Sandra Scott, Mark Deleva, Martin White, Fred Seigel, Walt Miller all agree yes to approve the minutes for June 2005.
