Planning Board Minutes
August 5, 2004
Members Present: Laura Silva Chairperson, Fred Siegel, Mark DeLeva, Bill Ruther, Martin White and Walt Miller, Kathy Jo Gallo, Secretary
Meeting called to order at 7:30pm.
Due to the heavy volume of applications questions were handled prior to the Public Hearings.
Paul Golden talked with the Board members about the possibility of erecting a small animal hospital on Route 20. Clarified the Zoning specifications of the parcel.
Public Hearings
1. Eric Brown, Owner/ Randy R. and Wendy Bell, property located on Gage Road. SBL# 65.0-1-31.3 is seeking a minor subdsivision approval on 3.28acres to be combined with the Bell property. There were no questions from the audience. Hearing closed.
2. David A. Carmen of 2422 Gage Road SBL#75.00-1-4.1 is seeking approval for a minor subdivision of 37.13 acres with 2.75 acres remaining with existing residence. One member of the audience questioned whether there were plans for the vacant land. Mr. Carmen has no plans for the land at this time. Hearing closed.
3. Eugene W. Hotaling Sr. of 1311 Eaton Corners Road, SBL#42.0-1-10.11 is seeking subdivision approval for 3 lots keeping the 2.83 acres +- with existing residence. There were no questions from the audience. Hearing closed.
4. Vincenzo Leonetti, Owner/Joseph Mazuryk, SBL#43.00-2-3.112 is seeking the approval of a 3 lot subdivision on Gordinier Road. There were no questions from the audience. Schenectady County recommendation was for a detailed site investigation but no reason was stated. Hearing closed.
5. Richard and Donna Russo of 184 Duane Lake Road, SBL#67.04-1-1 seeking approval to subdivide 11 acres +- into 3 vacant lots and lot #4 with house and outbuildings. Schenectady County recommendation stated concerns about the septic and well locations given the small size of the parcels and concern about the water supply. Audience concern regarding the size of the parcels being created and the watershed issue into Duane Lake. The parcels are in the L-1 district and are within the zoning limits for that district. Another member of the audience requested restrictions be placed on the parcels for future owners based on concerns regarding the water quality of Duane Lake. Board members clarified they have no control over the septic requirements or building specifications as long as future owners adhere to County requirements. Hearing closed.
New Business
Motion to accept the July minutes made by Laura Silva seconded by Mark DeLeva. Roll Call vote: Laura Silva-yes, Mark DeLeva-yes, Martin White-yes, Bill Ruther-abstain, Walt Miller-yes, Fred Siegel-abstain
1. Robert C. Bean regarding vacant land at 9283 State Highway 30. SBL#33.00-2-18.21 is applying for a Special Use Permit for the purpose of constructing a garage before the construction of a residence. The driveway and well are established. There is no septic at this time. This will be a pole barn construction and will be used to hold supplies for the building of the residence.
Motion by Laura Silva seconded by Fred Siegel, to set a Public Hearing for September 2, 2004 at 7:30pm on the Robert C. Bean of 9283 State Highway 30 application for a Special Use Permit for the purpose of constructing a pole barn on vacant land. Roll Call Vote: Laura Silva-yes, Fred Siegel-yes, Martin White-yes, Bill Ruther-yes, Mark DeLeva-yes, and Walt Miller-yes.
2. James A. Cole of 359 Knight Road, SBL#65.00-2-20.1 are proposing 2 outlines for a major subdivision of 15 lots. Mr. Cole presented plans to the Board members for a major subdivision and asked if there were any concerns prior to moving forward with the project. Ordinances allow for cluster development and the Board members referred Mr. Cole to the ordinance manual for specifications but saw no major issues to plans at this time.
3. Thomas R. Spoor owning property at 579 Duanesburg Churches Road is applying for a minor subdivision of 3.09 acres with residence. Mr. Spoor presented the Board members with a sketch of the subdivision. There were no major issues to plans for the subdivision at this time. A complete application has not been filed at this time.
4. Robert P. Van Natten is applying for a Special Use Permit for the purpose of building a two-family residence on Skyline Drive SBL#53.00-1-8.11. The Board members clarified that the building being planned was a two family residence. Motion made by Fred Siegel and seconded by Mark DeLeva to schedule a Public Hearing for September 2,2004 at 7:30pm on the Robert P. Van Natten application for a Special Use Permit for the purpose of building a two family residence.
5. Charles H. Wilbur and Sally Ann Wilber of 868 Main Street, SBL#66.00-1-10.1 are applying for a minor subdivision. Represented by Betsy Dupont. The Wilburs would like to sell acreage on Route 395. There were no issues raised by the board members for this subdivision. A completed application has not been submitted at this time.
6. Ken Myer of Depot Road spoke with the Board members about a proposed subdivision. There would be nine lots on 50 acres. All of the lots would be larger than five acres. There were no issues raised by the Board members at this time.
Old Business
1. Eric Brown, Owner/ Randy R. and Wendy Bell, property located on Gage Road. SBL# 65.0-1-31.3 is seeking a minor subdivision approval on 3.28acres to be combined with the Bell property. Schenectady County recommendation for approval of the subdivision to be contingent upon the 3 parcels being combined into one lot.
Motion made by Laura Silva seconded by Fred Siegel for a Negative Declaration on the Short Form EAF. Roll Call Vote: Laura Silva-yes, Fred Siegel-yes, Martin White-yes, Bill Ruther-yes, Mark DeLeva-yes, and Walt Miller-yes. Motion made by Bill Ruther seconded by Fred Siegel to approve the minor subdivision of Eric Brown’s lot to be added to the adjacent property of Randy and Wendy Bell. This must be one parcel as per the recommendation of Schenectady County. Roll Call Vote: Bill Ruther-yes, Fred Siegel-yes, Laura Silva-yes, Martin White-yes, Mark DeLeva-yes, and Walt Miller-yes.
2. David A. Carmen of 2422 Gage Road SBL#75.00-1-4.1 is seeking approval for a minor subdivision of 37.13 acres with 2.75 acres remaining with existing residence. Schenectady County raised concern about leach field being correct. Issue clarified by the Board members. Motion made by Bill Ruther seconded by Fred Siegel for a Negative Declaration on the Short Form EAF. Roll Call Vote: Bill Ruther-yes, Fred Siegel-yes, Laura Silva-yes, Martin White-yes, Mark DeLeva-yes, and Walt Miller-yes. Motion made by Fred Siegel seconded by Walt Miller to approve the David A. Carmen minor subdivision of 37.13 acres with 2.74 acres remaining with existing residence.
Motion to adjourn meeting by Laura Silva seconded by Fred Siegel. Roll Call Vote: Laura Silva-yes, Fred Siegel-yes, Martin White-yes, Mark DeLeva-yes, Bill Ruther-yes and Walt Miller-yes.
