Town of Duanesburg Planning Board Meeting

Meeting Called to Order 7:54PM
PUBLIC HEARING:
1. Donald & Dorothy Carlson: Seeking approval for a Minor Subdivision consisting of 32.93 acres +- on Mill Point Rd., zoned R-2 Residential, PT/O SBL #32.00-1-6.121 in the Town of Duanesburg. Mr. Carlson explained to the audience his two (2) lot Minor Subdivision proposal on Mill Point Rd.. The July 11, 2002 recommendations to the plat plan were completed. There was no audience participation for this public hearing. Closed public hearing for Donald & Dorothy Carlson.
2. Fred Dykeman: Seeking approval for a Special Use Permit in the Hamlet Dist., SBL #67.05-2-4 for the purpose of opening a retail store in the Town of Duanesburg, located on Rte. 20, Western Turnpike (near the intersection of Rt. 7 & Rt. 20). Mr. Dykeman explained to the audience that he planned to open a retail store that sold ice cream, gifts and crafts. There were no questions from the audience. Public Hearing closed for Mr. Dykeman.
REGULAR MEETING:
The minutes of July 11, 2002 were reviewed. Corrections as follows: Page 1, Under 6 Gen Pirrone, read, The consensus was that a "very high" majority of the audience & etc. – Delete "very high", the statement should now read, "The consensus was that a majority of the audience & etc. Page 2 under
NEW BUSINESS, Thomas A & Madeline M. Lawrence. "After reviewing the proposal, a motion was made by Bill Ruther and seconded by Fred Siegel to approve. This should have read,"After reviewing the proposal, a motion was made by Bill Ruther and seconded by Fred Siegel to declare the Short Form EAF a negative declaration. Roll Call Vote: Bill Ruther-yes, Fred Siegel-yes, Sherrie Wages-yes, Walt Miller-yes.
A motion was then made by Bill Ruther and seconded by Fred Siegel to approve the lot line amendment for Lot #1 and Lot #3 for Thomas A. & Madeline M. Lawrence for their Minor Subdivision, SBL #68.00-2-7.11.
A motion to approve the minutes with the corrections was not made because there were only two (2) members that could vote on it. It was suggested that a vote be taken at our September meeting.
NEW BUSINESS: None
OLD BUSINESS:
1. James & Tami Cole: Submitting plans for a Minor (1 lot) Subdivision consisting of 22 acres on Knight Rd., SBL # PT/O 53.00-3-20.1, zoned R-2 Residential in the Town of Duanesburg. After reviewing the preliminary plan, the planning board recommended they comply with the Subdivision Ordinance in showing a site map, existing house & well, septic disclosure, label the lots #1 & 2 and other pertinent information needed. A motion was made by Fred Siegel and seconded by Laura Silva to set up a public hearing for September 5, 2002 at 7:30 PM for James & Tami Cole’s Minor Subdivision, contingent upon having the recommended information submitted by August 22, 2002 to the Building Inspectors office. Roll Call Vote: Fred Siegel-yes, Laura Silva-yes, Sherrie Wages-yes and Walt Miller-yes.
OTHER:
1. Joseph Reagan of Gutha Rd., approached the planning board with regards to the Frost & Littman Subdivision on Gutha Rd., SBL #34.00-2-30, 37, 39, 40, 57, & 59, parcel A in the Town of Duanesburg. With the "New Subdivision (re-subdividing existing twelve (12) single family lots), the Regans’ are losing 60 ft. (sixty ft.) of right-away. It was suggested that the Reagans’ hire a lawyer and sought it out with the developer.
2. Ben Chase-Discussed plans for a musical festival at Indian Lookout Country Club. Mr. Chase stated that original plans were for August 16th, but could not be accomodated. The Tilted Caps Productions presents The Spot Rock-A Benefit for Cultural Survival Music Festival was the concert planned. After much discussion-tickets sold to date (20) and the fact that a permit would most likely be needed, the planning board suggested he try another location.
3. Randy Passonno of Collar City Auctions & Realty, Inc. wanted to discuss his future venture. Mr. Passonno did not show for his appointment.
OLD BUSINESS:
1. Donald & Dorothy Carlson: Seeking approval for a Minor Subdivision consisting of 32.93 acres +- on Mill Point Rd., PT/O SBL #32.00-1-6.121 in the Town of Duanesburg. After reviewing the application, a motion was made by Fred Siegel to declare a negative impact on the Short Form EAF and seconded by Sherrie Wages. Roll Call Vote: Fred Siegel –yes, Sherrie Wages-yes, Laura Silva-yes and Walt Miller-yes.
A motion was then made by Fred Siegel and seconded by Sherrie Wages to approve the Minor Subdivision for Donald & Dorothy Carlson of 32.93 acres +- on Mill Point Rd., PT/O SBL #32.00-1-6.121 in the Town of Duanesburg contingent upon Schenectady County Planning approval. Roll Call Vote: Fred Siegel-yes, Sherrie Wages-yes, Laura Silva-yes, Walt Miller-yes.

A motion was then made by Sherrie Wages and seconded by Fred Siegel to approve the application for a Special Use Permit to Fred Dykeman for the purpose of opening a retail store in the Town of Duanesburg Hamlet District, SBL #67.05-2-4, contingent upon the use restricted to the lower level of the building as indicated on the plot plan, plus all "88" Regulations approved by the Code Enforcement Officer for his "CO". Roll Call Vote: Sherrie Wages-yes, Fred Siegel-yes, Laura Silva-yes and Walt Miller-yes.
A motion was made by Fred Siegel and seconded by Sherrie Wages to adjourn the meeting. Roll Call Vote: Fred Siegel-yes, Sherrie Wages-yes, Laura Silva-yes and Walt Miller-yes.
